These Terms and Conditions (“Terms”) govern your access to and use of the OTORN Education website, learning platforms, and services available at www.otorneducation.com.

By accessing, registering, enrolling in courses, or using any services provided by OTORN Education (“OTORN”, “we”, “us”, or “our”), you agree to be legally bound by these Terms. If you do not agree, you must not use the website or services.


1. Definitions

  • “User” / “You” refers to any person accessing or using the website or services.
  • “Services” refers to online courses, training programs, learning management systems (including Moodle), certificates, and related offerings.
  • “Content” refers to course materials, videos, text, assessments, downloads, and other educational resources.

2. Eligibility and Account Registration

2.1 You must be at least 16 years old to register and use the services, unless parental or guardian consent is provided.

2.2 You agree to provide accurate, current, and complete information during registration and to keep your account details secure.

2.3 You are responsible for all activity conducted through your account.


3. Use of the Website and Services

3.1 You agree to use the website and services only for lawful purposes and in a manner consistent with these Terms.

3.2 You must not:

  • Share login credentials with unauthorized persons
  • Upload malicious software or harmful content
  • Copy, distribute, or resell course materials without authorization
  • Attempt to interfere with platform security or functionality

OTORN reserves the right to suspend or terminate access for violations.


4. Course Enrollment and Access

4.1 Course access is granted upon successful registration and, where applicable, payment confirmation.

4.2 Access duration, completion requirements, and assessment rules are specified within each course.

4.3 OTORN reserves the right to modify course content, schedules, instructors, or delivery methods where reasonably necessary.


5. Fees, Payments, and Refunds

5.1 Course fees are displayed on the website or communicated prior to enrollment.

5.2 Payments are processed through secure third-party payment providers. OTORN does not store full payment card details.

5.3 Unless otherwise stated:

  • Fees are non-refundable once course access has been granted
  • Refunds may be considered only in exceptional circumstances at OTORN’s discretion

5.4 OTORN reserves the right to change pricing at any time without affecting existing enrollments.


6. Certificates and Academic Records

6.1 Certificates are issued only upon successful completion of course requirements.

6.2 OTORN reserves the right to withhold or revoke certificates in cases of:

  • Academic misconduct
  • Fraud or misrepresentation
  • Breach of these Terms

6.3 Academic records may be retained for regulatory and verification purposes.


7. Intellectual Property

7.1 All website content, course materials, trademarks, logos, and intellectual property are owned by or licensed to OTORN Education.

7.2 Users are granted a limited, non-transferable, non-exclusive license to access content for personal learning purposes only.

7.3 No content may be reproduced, shared, sold, or published without prior written consent.


8. Privacy and Data Protection

8.1 OTORN processes personal information in accordance with its Privacy Policy, GDPR, POPIA, and applicable data protection laws.

8.2 By using the services, you consent to the collection and processing of personal data as outlined in the Privacy Policy.


9. Third-Party Services and Links

9.1 The website may integrate third-party tools (e.g. payment gateways, LMS hosting).

9.2 OTORN is not responsible for the availability, content, or practices of third-party services or websites.


10. Disclaimer of Warranties

10.1 Services are provided on an “as is” and “as available” basis.

10.2 OTORN does not guarantee:

  • Continuous or uninterrupted access
  • That courses will meet specific professional or regulatory requirements in all jurisdictions
  • Employment, promotion, or business outcomes

11. Limitation of Liability

To the fullest extent permitted by law:

11.1 OTORN shall not be liable for:

  • Indirect, incidental, or consequential damages
  • Loss of data, profits, or business opportunities

11.2 OTORN’s total liability shall not exceed the amount paid by you for the specific service giving rise to the claim.


12. Termination

12.1 OTORN may suspend or terminate access without notice if you breach these Terms.

12.2 Upon termination, your right to access services and content ceases immediately.


13. Governing Law and Jurisdiction

These Terms shall be governed by and interpreted in accordance with the laws applicable in Southern Africa, with due consideration to:

  • POPIA (South Africa)
  • GDPR (where applicable)
  • Applicable laws of Zambia

Jurisdiction shall lie with a competent court as determined by Otorn Education.


14. Changes to Terms

Otorn reserves the right to update these Terms at any time. Updated versions will be posted on the website with a revised effective date. Continued use constitutes acceptance of the updated Terms.
